  • In the beginning of your asylum procedure it will be assessed whether Germany is responsible for examining your asylum application or another European state is responsible. This is called the Dublin regulation.
  • Unfortunately you cannot decide which state examine your asylum application. This is why it need to be clarified when and where you arrived in the EU, whether your have family members in other member states, whether you applied for asylum in another member states, whether you arrive in Germany with visa from another member states, or whether you had your fingerprint taken in another member states.
  • You have the right to name reasons, why you cannot go back to this state, but if the Germany decides that another state is responsible for you, you have to go back to this state, that your application can be examine there.
  • If Germany sees another EU member state responsible for your asylum procedure, your asylum application is “inadmissible” [“unzulässig”].

  • Contact as soon as possible a lawyer or a free counselling office. You only have 2 weeks time for a legal complaint
  • Important aspects that make it easier to find a way for you to stay in Germany are
    • You are unable to travel due to health reasons
    • The EU country you are supposed to go back to doesn’t offer the most basic things to be able to survive like a bed, soap, bread (so-called “systemic deficits”)
